Johnson & Johnson Offers Historic $505M Deal To Talc Miners Amid Bankruptcy Fallout

As Johnson & Johnson faces ongoing lawsuits alleging that its talcum powder products cause cancer, the company is allocating substantial funds to resolve a long-running conflict with its suppliers. The proposed settlement involves Johnson & Johnson paying a minimum of $505 million to the bankrupt talc suppliers, Imerys Talc America and Cyprus Mines Corporation, by December 31, 2025. According to recent bankruptcy court documents, a portion of J&J's payments will be directed to the suppliers' settlement trust for talc claimants.

According to the proposed deal, Johnson & Johnson will first pay $225 million upfront, followed by an additional $280 million sourced from their insurance policies. This agreement follows the bankruptcies of Imerys in 2019 and Cyprus in 2021, as both companies sought protection from talc-related liabilities. Although other companies produce talc, Imerys has traditionally been the exclusive supplier of talc for Johnson & Johnson's cosmetic products. Legal filings indicate that lawsuits against Johnson & Johnson frequently include Imerys as a co-defendant.

The disputes between Imerys, Cyprus, and Johnson & Johnson revolve around indemnification agreements, which the talc suppliers argue should shield them from cancer-related liabilities. However, Imerys' 2019 bankruptcy filing reveals that Johnson & Johnson either denied the existence of these agreements or challenged their terms. In the midst of Johnson & Johnson's ongoing legal battles over its talc-based products, the company has reached a settlement with talc miners. As part of its recent bankruptcy plan for its talc litigation subsidiary, Johnson & Johnson has proposed almost $6.5 billion in settlement funds for ovarian cancer plaintiffs. Plaintiffs are currently considering this offer and are expected to vote on it by July 26.
